iTunes 8Are you someone who travels a lot? Well, crossing the border and making a purchase in the U.S. version of the iTunes Music Store is now a breach of the Terms of Service.

The Unofficial Apple Weblog (motto: “Not the Other Kind”) draws our attention to a new section in the American version of the ITMS TOS:

11. Territory. The Service is available to you only in the United States. You agree not to use or attempt to use the Service from outside of the available territory, and that Apple may use technologies to verify your compliance.

Now, as TUAW also points out, this is more likely set up to prevent people from buying TV programs in territories where they’re not yet for sale. Still, given the ubiquity of video streaming and bittorrent, it seems a bit ridiculous to prevent people from buying your product. And I also imagine that this was imposed on Apple by the media companies; after all, they’ll sell you just about anything…so long as you can play it on an iPod.

Read on for more analysis of the new TOS, as well as discussion of the expanded podcast management tools in iTunes 8.
