Apple is threatening the nuclear option- a complete shutdown of the iTunes Music Store- if a panel rules that it must be increased royalties to artists for their music. According to Wired the three-person Copyright Royalty Board, which is scheduled to rule by Thursday.

According to a blog on Wired.com, the Board is considering a push by music publishers to increase artists royalties for digital downloads to 15 cents per download, up from 9 cents. Apple believes that under that regime, its business model would become unprofitable.

“Apple has repeatedly made it clear that it is in this business to make money, and most likely would not continue to operate [the iTunes music store] if it were no longer possible to do so profitably,” Eddy Cue, an Apple vice president on the iTunes side, said in a statement submitted to the Board.
