The deal came together when Commissioner Deborah Taylor Tate agreed to cast the deciding “yes” vote, in exchange for the companies agreeing to pay more than $20 million in fines for past violations. XM and Sirius are expected to enter a consent decree, with XM paying $17.5 million and Sirius about $2 million.
Earlier in the day, Commissioner Jonathan Adelstein, who had offered to vote yes in exchange for stronger conditions than those previously in place, cast a “no” vote, placing the count at 2-2. Tate’s vote meant that the final 3-2 vote went exactly along party lines, with Chairman Kevin Martin, Tate, and Robert McDowell, all Republicans, voting yes and Adelstein and fellow Democrat Michael Copps voting no.
