EA faces lawsuit over Active 2.0

EA Sports Active 2.0 Electronic Arts is on the receiving end of a lawsuit brought forth buy a fitness firm named Active Network. Active Network claims it owns the trademark “Active” when it pertains to sports related activities and training services. Active Network is looking to halt the release of EA Sports Active 2.0 until this issue is settled.

According to a legal document recovered by Gamespot, Active Network believes EA Sports Active 2.0 infringes on its trademark as it pertains to, “providing information regarding the scheduling of participatory sports and recreational activities and sporting events; sports training services, namely, providing personal training schedules and programs.”

Active Network claims it registered the “Active” trademark in 2008. It also wants to protect the integrity of its Active.com website. It feels that EA Sports Active 2.0 provides some of the same activities its website does. These activities include, but are not limited to tracking calories online, chat rooms and various specific exercise regimens.

Active Network wants $75,000 in damages and preventative measures that will prohibit EA from using the word Active in any fitness game with online capabilities.

EA Sports Active 2.0 is expected to be released Fall 2010 for PS3, Wii, iPhone and iPod Touch.
